Problems with defined benefit pensions are back in the news. The twin issues of the drop in equities and falling interest rates have combined in a pincer movement to wipe out the gains from the mid to late 00s. It is so serious that more and more DB schemes are being closed to new entrants or even fully closed. However, the size of the problem and duration of the pensions legacy make it an issue that all TMA members need to be aware of and to understand.
Our February event brings together two pensions and restructuring experts from Freshfields who will comment on many aspects of pensions and employment advice, including acquisitions and disposals, joint ventures, terminations, pension scheme reconstructions, the implications of insolvency for employees and pensions, winding up pension schemes, High Court and employment tribunal litigation, pensions litigation and Esops.
Richard Tett has been a partner in the Freshfields restructuring and insolvency group since 2004, based in London.
He has broad UK and international restructuring experience across a range of finance and corporate areas. He has worked on insolvency appointments, distressed M&A, refinancings, out of court restructurings, US Chapter 11 cases, advising directors, insurance workouts, telecoms and insolvency aspects of structured finance.
Richard will be joined by David Pollard who is also a partner at Freshfields Bruckhaus Deringer LLP and a pensions law expert.
He is the author of the book: "Corporate Insolvency: Employment and Pension Rights" (Bloomsbury, 2009), a contributor to Tolley's Employment Law and Tolley's Insolvency Law, and co-editor of the book "Guide to the Pensions Act 1995" (Tolley, 1995). He is also co-editor of the journal Trust Law International.
In 1998 David was awarded the Wallace Medal by the Association of Pensions Lawyers for excellence in communicating pensions issues. From 2001 to 2003, he was the Chairman of the Association of Pension Lawyers (APL).
